MyMedsReminder Terms of Service
These Terms of Service ("Terms") govern your access to and use of MyMedsReminder, including our website, automated telephone reminder services, caregiver notification features, and related services (collectively, the "Service").
The Service is operated by Jeff Brown, doing business as MyMedsReminder ("MyMedsReminder," "we," "us," or "our").
By registering for, purchasing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Description of the Service
MyMedsReminder provides automated telephone calls intended to remind users about medication schedules they or their authorized representatives have configured.
Depending on the plan and features enabled, the Service may:
- Place automated calls at scheduled times.
- Deliver a medication reminder using an automated or artificial voice.
- Allow the recipient to acknowledge a reminder by speaking during the call.
- Retry a call according to the configured reminder protocol.
- Notify a designated caregiver or other authorized contact when a reminder call has not received an acknowledgment after the applicable retry process.
- Provide limited activity records or reports concerning reminder attempts and acknowledgments.
- Record calls where the recipient has given permission, so that the account holder can listen to them.
Features may vary by subscription plan or organizational agreement.
MyMedsReminder does not guarantee that every call will connect, that every notification will be delivered, or that a user will respond to a reminder.
2. The Service Is Not Medical Care
MyMedsReminder is a reminder and communication service, not a healthcare provider.
The Service does not:
- Diagnose, treat, or prevent any disease or medical condition.
- Determine which medications a person should take or prescribe medication schedules.
- Verify that a user has swallowed or otherwise taken medication.
- Determine whether a medication has been taken correctly or at the appropriate dose.
- Monitor a person's health, vital signs, seizures, or other medical conditions.
- Provide emergency response, clinical supervision, or continuous patient monitoring.
A spoken acknowledgment means only that the system received an acknowledgment through the telephone interaction. It does not establish that the intended recipient answered, took the medication, or followed medical instructions.
A missing acknowledgment does not establish that medication was missed. The recipient may be unavailable, the phone may be disconnected, or a technical issue may have occurred.
Users must continue to follow their healthcare professional's instructions and must not rely on MyMedsReminder as a substitute for medical advice, medication management, or emergency services.
For medical emergencies, contact 911 or the appropriate local emergency service.
3. User Responsibilities
You agree to:
- Provide accurate and current account, telephone, scheduling, and contact information.
- Configure reminders according to instructions provided by your healthcare professional, where applicable.
- Review reminder schedules for accuracy and update them when necessary.
- Maintain access to a working telephone and notify us of changes to relevant contact information.
- Ensure that any caregiver or other contact information you provide is accurate and that you have the necessary authority and permissions to provide it.
- Use the Service only for lawful purposes.
- Notify us promptly if you discover an unauthorized use of your account or an incorrect reminder schedule.
You are responsible for reviewing your reminder schedule and ensuring it remains appropriate. MyMedsReminder does not independently verify prescriptions, medication instructions, or changes made by healthcare professionals.
We may suspend or restrict access when necessary to protect users, comply with law, investigate misuse, or address security risks.
4. Accounts for Other People and Caregiver Authorization
You may be able to arrange reminders for another person if the applicable plan supports this feature and you have the legal authority and permissions required to do so.
You represent that you have obtained any necessary consent or authorization before enrolling another person, providing their information, or arranging automated calls to their telephone number.
Where required, the person receiving reminders must provide their own consent.
A family relationship, caregiver role, or payment for a subscription does not automatically grant legal authority to consent on another adult's behalf or access that person's health information.
You must identify caregiver contacts accurately and obtain any required permissions before we send them notifications.
We may require additional verification where reasonably necessary to confirm authorization or protect personal information.
5. Automated Calls, Consent, and Opt-Out
The Service uses automated telephone technology to deliver reminders and, where enabled, related notifications.
By enrolling a telephone number for automated calls, you confirm that you have the authority to provide the number and that the required consent for the applicable calls has been obtained.
Consent requirements may vary depending on the type of call, the technology used, the recipient, the purpose of the communication, and applicable federal and state laws.
Where required, we will obtain and document appropriate consent before placing automated calls.
You may withdraw consent for automated calls by using the opt-out method provided in the call, where available, or by contacting us at admin@mymedsreminder.com. We will process opt-out requests as required by applicable law.
Withdrawing consent may disable some or all Service features.
We will not condition consent to marketing calls on purchasing the Service. Marketing communications, if offered, will be handled separately from medication reminders as required by law.
You agree to notify us if a telephone number changes ownership, is reassigned, or should no longer receive reminders.
6. Reminder Schedules and Notifications
Users or authorized representatives are responsible for configuring reminder times, time zones, telephone numbers, and designated contacts accurately.
The Service may attempt to retry unanswered calls or send notifications according to the selected plan or configured protocol. The precise number of attempts, timing, and available notification methods will depend on the applicable Service configuration.
We cannot guarantee that a call or notification will reach its intended recipient. Delivery may be affected by mobile carriers, telephone network conditions, disconnected devices, spam filters, incorrect contact information, power outages, third-party service interruptions, or other circumstances outside our reasonable control.
Unless expressly agreed in a separate written contract, MyMedsReminder does not provide a continuously staffed response center and does not guarantee that a caregiver will respond to a notification.
Users and caregivers must not treat an unanswered call or notification as proof of a medical emergency or proof that medication was missed.
7. Subscriptions, Fees, and Billing
The fees, billing frequency, included features, and subscription duration applicable to your account will be displayed at checkout or specified in your written service agreement.
Depending on the offering, plans may include monthly subscriptions, prepaid packages, or business-to-business contracts.
For consumer subscriptions:
- You authorize us and our payment processor to charge the payment method you provide for the applicable fees.
- Recurring subscriptions will renew automatically only where the renewal terms are disclosed and applicable consent requirements are satisfied.
- You may cancel future renewals through the cancellation method we make available.
- Cancellation generally prevents future renewal charges but does not automatically refund a previously paid period, except where required by law or stated in the applicable offer.
- Prepaid plans expire at the end of their stated service period unless the offer expressly provides otherwise.
We will disclose applicable prices, renewal terms, and material fees before purchase. We will not charge undisclosed subscription fees.
If a payment fails, we may suspend the affected Service after providing any notice required by law or the applicable plan.
Business customers are subject to the pricing, invoicing, payment deadlines, and cancellation terms in their written agreements.
8. Refunds and Cancellation
Unless a different refund policy is disclosed at purchase, subscription fees are nonrefundable for elapsed service periods, except where a refund is required by applicable law.
If a specific offer includes a refund period or satisfaction guarantee, the terms of that offer will apply.
You may cancel your subscription using the cancellation method provided in your account or by contacting admin@mymedsreminder.com.
We may suspend or terminate accounts for material breaches of these Terms, fraudulent activity, misuse, nonpayment, or circumstances where continued operation would create an unreasonable legal, security, or safety risk.
Where appropriate and legally required, we will provide notice and an opportunity to correct the issue before termination.
9. Privacy and Personal Information
Your use of the Service is also governed by our Privacy Policy, available at https://mymedsreminder.com/privacy.
Depending on the features you use, we may process information such as:
- Names and contact details.
- Telephone numbers and reminder schedules.
- Caregiver contact details and authorization records.
- Call attempts, delivery information, and acknowledgment records.
- Call recordings, where the recipient has given permission.
- Account, billing, support, and technical information.
We will describe our information practices, retention periods, disclosures, and applicable user rights in the Privacy Policy.
You should not provide unnecessary medical information through the Service.
Where MyMedsReminder acts as a business associate under the Health Insurance Portability and Accountability Act (HIPAA), we will enter into the required business associate agreement with the relevant covered entity or business associate and implement applicable safeguards before handling protected health information in that capacity.
The applicability of HIPAA and other privacy laws depends on the parties, the data, and the services involved. Nothing in these Terms represents that every use of the Service is automatically HIPAA-compliant or exempt from healthcare privacy requirements.
10. Third-Party Services and Communications
The Service may depend on third-party telephone carriers, cloud hosting providers, messaging services, payment processors, and other technology vendors.
These providers may be subject to their own terms and operational limitations.
We will take reasonable steps to select and manage appropriate service providers, but we cannot guarantee uninterrupted operation of third-party networks or systems.
We remain responsible for our own obligations under applicable law and any agreements we enter into with customers.
11. Service Availability and Changes
We intend to provide the Service reliably but do not guarantee uninterrupted, error-free, or universally available operation.
We may update, maintain, modify, or discontinue features when reasonably necessary for technical, operational, security, legal, or business reasons.
Where a change materially affects a paid service, we will provide notice or other remedies where required by law or the applicable customer agreement.
We will not knowingly represent a feature as available if it has not been implemented and made available to the applicable customer.
12. Intellectual Property
MyMedsReminder and its licensors retain all rights in the Service, including its software, branding, design, documentation, and related materials, except for rights expressly granted to users.
Subject to these Terms, we grant you a limited, nonexclusive, nontransferable right to use the Service for its intended purpose during your authorized subscription or contract period.
You may not copy, resell, reverse engineer, interfere with, or commercially exploit the Service except as permitted by law or expressly authorized in writing.
These Terms do not transfer ownership of the Service to you.
13. Acceptable Use
You may not use the Service to:
- Place unlawful, harassing, deceptive, or unauthorized calls.
- Enroll individuals without required consent or authority.
- Impersonate another person or misrepresent the nature of a call.
- Send notifications to unauthorized contacts.
- Interfere with system security or availability.
- Use the Service to provide emergency monitoring or clinical services that it has not been designed and authorized to provide.
- Violate applicable privacy, telecommunications, consumer-protection, or healthcare laws.
We may investigate suspected misuse and take proportionate action, including suspending access or reporting conduct where legally required.
14. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided on an "as available" basis, subject to the express commitments made in these Terms or a separate written agreement.
We do not warrant that the Service will prevent missed doses, improve clinical outcomes, prevent hospitalization, or eliminate medication-related risks.
We do not warrant that every call, acknowledgment, or caregiver notification will be successfully transmitted or received.
Nothing in these Terms excludes a warranty or legal protection that cannot lawfully be excluded.
15. Limitation of Liability
To the maximum extent permitted by applicable law, MyMedsReminder and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Service, including loss of profits, loss of data, or business interruption.
To the maximum extent permitted by law, our aggregate liability for claims arising out of or relating to the Service will not exceed the greater of: (a) the fees you paid directly to MyMedsReminder for the Service during the twelve months preceding the event giving rise to the claim; or (b) $100.
This limitation does not apply to the extent prohibited by law and does not purport to exclude liability that cannot legally be limited, including any applicable liability for fraud, willful misconduct, or other nonwaivable obligations.
Nothing in this section overrides a separate written agreement that expressly provides different terms.
16. Indemnification
To the extent permitted by applicable law, you agree to be responsible for third-party claims arising directly from your unlawful use of the Service, your material breach of these Terms, or your violation of another person's rights.
This provision does not require you to indemnify MyMedsReminder for claims caused by our own negligence, willful misconduct, violation of law, or other conduct for which responsibility cannot legally be transferred.
Any additional indemnification obligations for business customers must be set out in a separate written agreement.
17. Termination
You may stop using the Service at any time and cancel your subscription under Section 8.
We may suspend or terminate your access in accordance with these Terms and applicable law.
Upon termination:
- Your right to use the affected Service will end.
- Any outstanding, properly payable fees remain due.
- Data will be retained, returned, or deleted in accordance with the Privacy Policy, applicable law, and any applicable written agreement.
- Certain provisions, including those relating to intellectual property, disclaimers, liability, and dispute resolution, will survive to the extent necessary to give them effect.
Where required by law or contract, we will provide reasonable assistance with data access, return, or transition.
18. Disputes and Governing Law
These Terms will be governed by the laws of the State of Maryland, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any dispute will be handled by a court or other forum with appropriate jurisdiction, subject to mandatory consumer-protection rules and any separate written agreement.
Nothing in these Terms prevents a consumer from exercising a nonwaivable right to bring a claim before a competent regulator, agency, or court.
19. Changes to These Terms
We may update these Terms from time to time.
We will update the "Last Updated" date and provide notice of material changes where required by law. Where affirmative consent is legally required, we will obtain it before applying the revised terms.
Continued use of the Service after a change takes effect constitutes acceptance only to the extent permitted by applicable law.
